Experience

Roman is the Head of both the Commercial Law Practice Group and the Arbitration Practice at B2RLaw. Roman is an advocate at the District Bar Association in Warsaw. He has over 15 years of experience in providing commercial legal advice to companies, as well as representing them in all forms of dispute resolution, be it litigation, arbitration and in settlement talks. He has been recognized by Legal 500 for both Dispute Resolution and Employment.

He is a citizen of both Poland and Canada and is a native speaker of both Polish and English.

Dispute Resolution

Roman has represented clients from numerous industry sectors in disputes that concerned a wide range of legal issues. He strongly believes in the need to efficiently communicate strategy, Polish legal issues (especially to international clients) and keep clients timely informed on legal costs, as only such an approach ensures that clients remain in control of such proceedings.

Roman thrives in complex litigation and arbitration cases, especially when the need arises to cooperate with party-appointed experts. He also has experience in managed dozens of litigation cases for an entire group of companies.

Roman also advises clients on ADR solutions, keeping in mind the cost of litigation and arbitration, their duration, as well as the financial interest of the clients. He has negotiated complex settlement agreements as an alternative to resolving matters before a court or tribunal.

Arbitration

Given that the majority of arbitration matters enjoy a heightened level of confidentiality, Roman cannot share all of his experience publicly. However, below are a few examples of his over decade-long experience in arbitration. Roman has advised and represented:

  • a real estate investor in Bilateral Investment Treaty expropriation claims against the Polish government after a decision of state authorities denying the investor land rights,
  • a defence industry multinational in ICC Arbitration against a Polish state-owned entity,
  • a structural design company in international ad hoc arbitration concerning claims arising due to events in Romania,
  • a real estate investor in arbitration against a Polish entity over claims concerning a shopping centre,
  • a management consulting firm on their role in a dispute over an international investment in a Polish entity.

Commercial law

Roman advises clients both at a management level on strategic projects and in organizing day-to-day advice to companies. He oversees the work of groups of lawyers dedicated to a specific client or industry sector. In doing so, he works closely with management, in-house lawyers or coordinators in order to provide seamless and timely assistance. He strongly believes that a lawyer needs to understand the client’s business and internal structure in order to be a source of solutions that are not only legally sound, but also practical from a business perspective.

Roman has advised clients in the following sectors: management consulting, international investments, aerospace and defence, compliance, corporate, real estate and construction matters, insurance and reinsurance matters, labour law/employment matters, energy and renewable energy matters, IP and data protection matters, bankruptcy cases, among others.

Pro bono

Social responsibility is not just a marketing catchphrase, but a mission statement that reflect Roman’s core values. Roman is regularly engaged in pro bono work and also encourages his team members to get involved as well. He believes it is an advocate’s obligation to give back to the community as well as support those that are less fortunate or oppressed. Roman has been recognized for his pro bono work by the Polish Ombudsman. His recent pro bono efforts concentrate on three areas: LGBTQ Rights, Women’s Rights and the Freedom of the Press.

  • Lead external counsel for the Polish office of a US-based global management consulting firm, negotiating contracts on their behalf, ensuring compliance with global standards, as well as overseeing a dedicated team of lawyers, a secondment program, employment/labour law and GDPR advice.
  • Advising an international aerospace and defence company on Polish labour law matters and working closely with international corporate structures.
  • Representing a leading New York and London-based private equity firm, a Luxembourg company and a group of Polish logistics, transportation, railway and mining companies in complex settlement talks with an ex-CEO of the Polish group that ended up being resolved amicably.
  • Representing a US foundation, Polish foundation and a Polish company in a sensitive labour dispute with an ex-manager.
  • Representing and advising senior partners of an a leading independent private equity fund manager in relation to risks arising out of criminal proceedings being conducted with regard to a Polish investment.
  • Representing an international property management firm and their SPV (owner of a shopping centre) in a dispute with one of the tenants over complex technical issues that was heard by the Court of Arbitration at the Polish Chamber of Commerce.
  • Advising the Electric Insurance Company – group insurer of the General Electric Company (GE) – on Polish legal and insurance matters relating to a PKN Orlen CCGT unit investment.
  • Managing several dozen litigation cases for a group of Polish logistics, transportation, railway and mining companies and representing the client in court, including key cases concerning railway accidents.
  • Representing a leading manufacturer of charging infrastructure for electric vehicles in key litigation cases.
  • Advising a Polish e-commerce company with regard to a litigation matter in Ireland brought by an international airline company (incl. selection process of Irish law firm/solicitor).
  • Advising clients from the Polish real estate sector in disputes against both commercial and municipal entities over the ownership of land, the right of perpetual usufruct (RPU), the lease of retail space and rights under master leases.*
  • Advising an international consortium in a dispute with the Polish General Directorate of National Roads and Motorways (GDDKiA), commissioning expert reports and overseeing their preparation.*
  • Advising a property investor and asset management firm on a possible claim against another international law firm for malpractice and conducting talks with the general counsel of said firm regarding an amicable resolution of the dispute.*
  • Representing a global engineering consultancy firm as respondent in an engineering dispute before an ad hoc Arbitral Tribunal. The engineering dispute concerned an incident at a major Romanian commercial centre and required cooperation with Polish and foreign experts on complex technical matters. The claim against the client was successfully defended and significant legal costs were awarded to the client.*
  • Representing a major UK reinsurance company regarding a subrogated claim concerning an incident at a Polish power plant. This case required extensive incident investigation with the cooperation of Polish and foreign experts across several areas of specialization from technical issues to a business interruption forensic investigation.*
  • Advising US VC fund Learn Capital on its USD 80 million Series D investment in Polish founded online learning platform Brainly.
